1.Object
1.1- These conditions regulate all sales contracts concerning "Products" ( which means products whose essential characteristics, price and delivery methods are indicated on the "site" www.happyyears.it ) concluded between the "HAPPY YEARS", which means Happy Years, with registered office in via Felice Cavallotti, 49/D - 51016 Montecatini Terme (PT) ( VAT 01839800479- email: info@happyyears.it) and "the BUYER", which means the person registered on the Site ( natural person over age, company or other body). The contractual and legal provisions relating to consumers ( in particular Legislative Decree no.206/2005 "Consumer Code" ) will apply only if the Buyer is a natural person, over age, who acts for extraneous purposes any entrepreneurial, commercial, craft or professional activity that may be carried out.
2.Orders and conclusion of the sale
2.1-The sale is concluded with the acceptance of the order. The order is formulated by the Buyer, in a binding and irrevocable way ( except for the withdrawal mentioned below ), following the insertion of the Products in the "virtual cart", by selecting ( "click" ) the option "select the method of payment: Pay with PayPal ". It is accepted by Happy Years, following the successful completion of the payment, through the "Order Confirmation" sent by the latter, within the following approximately 48 hours, to the email address indicated by the Buyer.
2.2-The characteristics of the Products may vary over time and, if this occurs after the order has been formulated and not yet accepted, Happy Years will send the Buyer a communication proposing the new conditions to be accepted for the conclusion of the sale; if the Buyer does not accept the proposal, any sums already paid will be refunded.
2.3-The tax document containing the tax data indicated by the Buyer ( tax code or VAT number ) is sent to the Buyer together with the Products.
3.Conformity,safety,defects and guarantee of the Products
3.1-For the conformity of the Products and for the relative guarantee, the producer is responsible directly to the Buyer according to what is established contractually and/or by law. The manufacturer is also liable, in accordance with the law for the safety and possible defectiveness of the Products and for any damage caused by them.
3.2-For product conformity, defects must be reported by the consumer, under penalty of forfeiture, within one month of delivery ( complaint not necessary if the seller has recognized the defect or has concealed it ). In the event of defect the consumer has the right, in accordance with the law, to restore, without charge, the conformity of the product by repair or remplacement, or to an adequate reduction in the price or termination of the contract.
4.Price and payment
4.1-The prices of the Products indicated on the website www.happyyears.it are subject to change : the price indicated at the time of conclusion of the sale is considered binding as provided for in art.2. The special offers and discounts are valid only in the indicated period of time and if in force at the time of the conclusion of the sale.
4.2-Payment is made through the online payment system with PayPal.
5.Territoriality
5.1-The territory of Italy means the territory subject to the sovereignty of the Italian Republic.
6.Delivery
6.1-The delivery of the Products to the Buyer's address indicated with the order will take place, on behalf of the Buyer, by UPS express courier.
6.2-The cost of shipping is calculated automatically at the time of the order and is communicated with its acceptance-confirmation.
6.3-The arrival of the Products at the destination is expected within the indicative term of 20-30 days from the order confirmation, without Happy Years assuming any responsibility for any damage or delay in transport, without prejudice to the obligation of Happy Years to place the confirmed order within thirty days.
6.4-If the Product is not available in stock within the term of thirty days provided above and in the quantity ordered by the Buyer, Happy Years within the same term will inform the Buyer and will refund the corresponding price if already paid.
7. Withdrawal
7.1- These provisions apply only if the Buyer is a consumer, with reference to the legislative decree of 21 february 2014, n.21 implementing directive 2011/83/EU on consumer rights.
7.2- The Buyer's right of withdrawal is exercised by sending, within 14 calendar days of receipt of the Products, a written communication to the Happy Years headquarters ( Happy Years- via Felice Cavallotti, 49/D- 51016 Montecatini Terme- PT ) by registered letter with acknowledgment of receipt. The communication can be sent, within the same term, also by telegram, email ( fax 0572-72030, mail: info@happyyears.it ) , provided that it is confirmed by registered letter with acknowledgment of receipt sent within the following forty-eight hours. The registered letter is considered sent at the time of delivery to the accepting post office. This communication must contain the order number and the one shown on the transport document ( remittance no ) . The codes of the Products that you intend to return as well as the coordinates ( including IBAN code ) of the current account where you receive the sums to be returned. Upon receipt of the goods, the Company reserves the right to evaluate their integrity. Upon the outcom of this evaluation, if any defects in the Products are recognized as objective, Happy Years will refund the amount due within 14 days.
7.3- The Buyes is required to return to Happy Years, at the following address Happy Years- Returns Service- via Vangile, 127- 51010 Massa e Cozzile- PT ( tel.0572-72030 ) , the Products for which the withdrawal is exercised by aforementioned 14 calendar days from receipt of the same. The Products are considered returned when they are delivered to the carrier, however the return takes place at the Buyer's expense and risk ( cash on delivery or freight collect will be rejected ). The substantial integrity of the Products is an essential condition for exercising the right of withdrawal: the Products must be returned with the original packaging, documentation received on delivery and in a normal state of conservation, which implies diligent storage and use.
7.4- Happy Years will reimburse the consumer the amounts paid for the Products for which the right of withdrawal has been exercised in accordance with the provisions of this legislative decree. The refund will be made free of charge, as quickly as possible and in any case within 14 calendar days from the date on which Happy Years became aware of the exercise of the right of withdrawal.
8. Disputes
8.1- For any controversy the Court of Pistoia is exclusively competent.
